Short version: Use ARKETA fairly, pay for Pro if it's useful, don't abuse the service. ARKETA uses AI, which can be wrong — always double-check important reminders, and never rely on it alone for medication or anything safety-critical. The app is provided "as is." This agreement is between you and the developer, not Apple.
This End User License Agreement ("EULA" or "Terms") is a binding agreement between you and the independent individual developer of ARKETA, based in Cyprus ("we," "us," the "Developer"). It is concluded between you and the Developer only, and not with Apple Inc. The Developer — not Apple — is solely responsible for the app and its content.
ARKETA is licensed, not sold, to you. This EULA incorporates by reference Apple's standard Licensed Application End User License Agreement and the Apple Media Services Terms and Conditions. Where any term here is less protective of your statutory consumer rights than mandatory law in your country, that mandatory law prevails.
We grant you a limited, non-exclusive, non-transferable, revocable license to use ARKETA on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules. You may not distribute or make the app available over a network where it could be used by multiple devices at once (except as allowed by Apple Family Sharing). You may not transfer, rent, lease, lend, or sublicense the app.
The Developer is solely responsible for providing any maintenance and support for ARKETA, as required by law. Apple has no obligation whatsoever to furnish any maintenance and support services for the app. Support questions: hello@arketa-app.com.
Each capture sends a real AI request to our servers. To keep the service fast and sustainable, Pro accounts have daily limits:
Limits reset every 24 hours. The vast majority of users never approach them.
ARKETA uses artificial intelligence to interpret your input and create tasks, dates, reminders, and other items. AI can misunderstand, misclassify, or set the wrong date or time.
ARKETA is a productivity aid, not a medical, healthcare, financial, legal, or safety-critical service. Do not rely on it alone for medication, medical appointments, or any situation where a missed or incorrect reminder could cause harm. Always use an appropriate professional or dedicated tool for such needs.
You retain ownership of the content you create. Your captures are stored locally on your device. See our Privacy Policy for full details on data handling. You are responsible for the legality of the content you submit for AI processing.
The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) of the app to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR OPPORTUNITIES, OR FOR MISSED OR INCORRECT REMINDERS, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP. WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM. Nothing in these Terms limits liability that cannot be limited under applicable law (such as for death, personal injury, or fraud).
The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your use of it, including but not limited to: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the app or your use of it infringes that third party's intellectual property rights, the Developer — not Apple — will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict-of-law rules, and subject to the Apple Media Services Terms. This does not deprive you of any mandatory consumer-protection rights in your country of residence; disputes may also be brought before the competent courts of your place of residence where required by law.
We may update these Terms. Continued use after changes means you accept the new Terms. Significant changes will be noted in release notes and in the "Last updated" date above.
